Deli'Dej and its Clients together are hereinafter referred to as the "Parties".

 

The terms "Product" or "lunch box" designate the goods offered for sale on the site.

 

1. Scope and object

The consumer declares to have full legal capacity allowing him to engage under these general conditions of sale.

These general conditions of sale express all the obligations and rights of both parties. In this sense, the consumer is deemed to accept without reservation all of the provisions provided for in these said conditions. Deli'Dej, for its part, undertakes to respect its role as seller within the framework of these same conditions.

Any order validated by the consumer, within the site www.delidej.com implies the prior acceptance of these general conditions and does not require a handwritten signature, insofar as the consumer orders the products presented online.

The fact that the Customer ticks the box "I accept the T&C" before confirming his order automatically entails the express acceptance by the latter and without restriction or reservation of these Conditions. The Customer acknowledges by this act having read and understood these Conditions and accept them.

Purchases by e-mail, by telephone or by post also imply the acceptance of these Conditions which he acknowledges having previously read, understood and accepted under the conditions mentioned above.

Any Internet user or customer can, at any time, read the general conditions of sale on the site www.delidej.com or at the Customer's request, by e-mail or by post. 2. Special conditions of sale

Delivery and distribution of products is only possible in the places indicated in the "school" mention of the customer profile

Due to the reuse of lunch boxes, the consumption of products is only planned within the school itself.

 

3. Access to the site

Deli'Dej strives to keep the website accessible without being under any obligation to do so. Access to the Site may be interrupted for maintenance, updating, or for any other technical reason. The company Deli'Dej is, at any time, no responsible for these technical and temporary interruptions and the consequences or inconveniences that may result for Visitors or Customers.

 

4. Subscriptions - Orders

Orders and subscriptions are exclusively received via the Internet. Any orders entail an obligation of payment. The customer also guarantees that he is fully authorized to use the payment information provided during the registration. SEPA Payments provide access to sufficient funds to cover all the costs resulting from the use of the services of the site.

 

For ponctualorders:

- The customer places an order on the site and pays according to the conditions indicated in paragraph "payment"

- Once payment of the corresponding price has been made, the order is considered final

- An order confirmation email is sent to the customer's email address (indicated in the profile)

 

For subscriptions:

- The customer specifies his subscription request on the site (days requested, children concerned, type of menus, etc.)

- An email confirming the subscription is sent to the customer's email address (indicated in the profile)

- Within 24 hours, a confirmation email is sent specifying the amount of the first debit and the date of the first delivery

- A first quarter payment and direct debit authorization link is integrated into the email.

- Once payment has been made, the subscription is effective

- Payments for the following quarters will be announced by email and made by direct debit

4.1. Special case for lunch break childcare in the International French School (IFS)

As the supervising is mandatory during the lunch break, the customer commits to pay Delidej according the the section "payment"

 

5. Price

The prices of the site are indicated in euros all taxes (TTC). They are applicable during the validation of the order by the consumer. Prices are subject to Dutch VAT, i.e. 9%. Any change in the legal rate of this VAT will be reflected in the price of the products presented on the Deli'Dej site, on the date stipulated by the relevant implementing decree.

In the case of a subscription, a flat-rate contribution of 10 (ten) euros is requested for the lunch box and the costs of setting up the subscription.

For ponctual orders, in the event of non-return of the lunch box after consumption, a fee of € 30 (thirty) will be claimed.

 

6. Modification or cancellation

You can modify or cancel your subscription or order at any time. For this, the customer must contact the Deli'Dej team using the contact form on the site. However, notice periods exist

For a ponctual order:

- The order can be canceled or modified 5 (five) calendar days before delivery

For a subscription:

- The subscription can be changed 10 (ten) calendar days before delivery (occasional absence of the child)

- The subscription can be canceled with a notice of 1 (one) calendar month

The reimbursement of sums already paid will take place within 15 (fifteen) calendar days following the request.

 

7. Delivery - Distribution

Delivery and distribution are made during the lunch pause.

 

8. Payment

In the case of punctual orders, payment will be made only on the delidej.com site by credit card using the iDeal system. Non-Dutch bank cards are therefore not accepted.

In the case of subscriptions, payment will be made by direct debit (or by transfer). Payment will be due for the coming quarter. After a subscription request, a confirmation email will specify the amount and date of the direct debit or the date of the transfer at the latest.

Any delay in payment will result in the cessation of the supply of products

In the event of a specific partnership, payment can be made within a period agreed with the customer by bank transfer only.

If the Client is a professional, in the event of late payment, late payment interest will be applied at a rate equal to three times the legal interest rate until the day of final settlement. In addition, Deli'Dej will be entitled to a lump sum indemnity for recovery costs in the amount of forty (40) euros. Late payment penalties and this lump sum are payable automatically without the need for a reminder.

Special case for lunch break childcare : payement will be performed by monthly direct debit

 

9. Guarantee

The Products offered comply with the Dutch legislation in force and the standards applicable in the Netherlands.

Deli'Dej is committed to ensuring the proper conservation of the goods during transport and storage before distribution.

• storage of cold Products between + 4 ° C and + 8 ° C and consume them before the “best before date”
• Keep the Products delivered warmed in insulated packaging and distribute them quickly

If storage between <8 ° C is not possible, the Products must be consumed within 2 hours, in a storage place not exceeding + 20 °C.

 

The menus for the 2 weeks are presented on the site. However, depending on the availability of ingredients, Deli'Dej reserves the right to modify the menus without notice.

 

10. Responsability

Deli'Dej cannot be held responsible for any inconvenience or damage due to the use of the Internet network, in particular a break in service, an external intrusion, the presence of computer viruses, the fraudulent use of the bank card. , etc.

The site is exempt from its contractual or legal obligations in the event of force majeure which totally or partially prevents the execution of the contract. The obligations of the site are suspended for the duration of the force majeure at the end of which the deadlines which had been suspended start to run again.

13. Applicable law and competent jurisdiction
